When Are You Able To Claim Compensation For A Stabbing?

The Criminal Injuries Compensation Authority (CICA) is an agency that can award compensation to those in Great Britain who have been a victim of a crime of violence.

Before you can claim compensation for a stabbing through the CICA, you will need to demonstrate that you were unable to claim compensation via any other avenue, such as directly against the perpetrator or against a vicariously liable party.

You will also need to ensure that your case meets the following eligibility requirements to be able to claim compensation through the CICA:

  1. You must have suffered an injury, either mental or physical, in a crime of violence. The Scheme lists some examples of incidents considered a crime of violence. This includes physical attacks, (so this may also include attempted murder and physical assault), sexual assault, a threat of attack and arson.
  2. This incident must have occurred in one of the countries that are a part of Great Britain (Wales, England or Scotland), or another relevant place, such as a ship or aircraft registered here.
  3. The stabbing incident you were injured in must have been reported to the police.

What Do You Need To Claim Through The CICA?

When making a stabbing compensation claim through the CICA, you will need to provide the following information:

  • Evidence showing you qualify for the CICA’s residency requirements.
  • Medical evidence about your injuries.
  • Proof that you reported the incident to the police, e.g. your police reference number.

By providing the CICA with your police reference number, they will be able to liaise with the police for any further information they may need regarding your claim.

Is There A Time Limit When Seeking CICA Compensation?

When claiming through the CICA, you must ensure that you begin the claiming process within 2 years of the date the incident took place. If exceptional circumstances prevented you from making your claim within this time, exceptions could be made.

The time limit for those injured under the age of 18 are as follows:

  • If the incident took place while you were a minor, and you reported it to the police, you will have 2 years from the date you turn 18 to begin the claiming process, provided that exceptional circumstances don’t apply.
  • If the incident took place when you were a minor and no report was made to the police, you will have 2 years from the date this report is made to begin the claiming process, provided that exceptional circumstances don’t apply.

Is There An Average Compensation For Being Stabbed?

All successful stabbing compensation claims made through the CICA will award the claimant compensation for their criminal injuries. For example, this could include the scarring that results from injuries to the face during an assault and your stab injuries.

Criminal injuries compensation amounts are awarded in accordance with the injury tariffs listed within the Scheme. These tariff amounts are fixed, meaning you will receive the exact figure that is listed for your injury. The table contains some of these tariff figures, so please consult them to get an estimate of CICA payouts.

Additionally, under the multiple injuries formula, you could receive compensation for up to 3 injuries. You would only receive 100% of the listed compensation amount for your highest-valued injury. For the second and third, you would receive 30% and 15% of the tariff amount, respectively.

If you became pregnant, contracted an STI or lost a pregnancy due to a crime of violence, compensation may be awarded differently.

Claiming Special Expenses Through The CICA

In addition to receiving compensation for your physical or psychological injuries, you could also receive special expenses. These could include:

  • Care costs relating to helping you with food preparation or your bodily functions.
  • Glasses, hearing aids or other physical aids you depended on that were damaged in the incident.
  • The installation of a ramp, stairlift or other home modifications to help cope with your injuries.
  • Kitchen equipment, a specially adapted car or any other equipment you may need to help cope with your injuries.

These costs must not be available for free anywhere to be eligible to claim them through the CICA. They must also be reasonable, necessary and directly resulted from your injuries.

Can You Make A Compensation Claim For Assault On A No Win No Fee Basis?
